Terms of Service

Version 2026-05-19 · last updated 19 May 2026

These terms govern your use of Brightspark Prep ("the service"), operated by Himanshu Kher (sole trader) ("we", "us"). Contact: himanshu.kher@gmail.com. By using the service, and in particular by buying paid access, you agree to these terms. The account holder must be 18+ and the parent or guardian of the child using it.

1. The service

Brightspark Prep is an educational practice tool for UK 11+ / senior school entrance preparation across Maths, Verbal Reasoning, Non-Verbal Reasoning and English. Maths practice is free and needs no account. Paid access unlocks the other subjects, mock exams, smart review, readiness analytics and printable worksheets.

2. Paid access, pricing & duration

All plans are a single one-off payment — no subscription and no automatic renewal. Prices are in GBP and include UK VAT where applicable. Access begins when payment completes and ends after the stated period. Access is tied to your account, is for personal family use, and is non-transferable — sign-in links and accounts must not be shared, resold or used to provide a service to others.

3. Payment

Payments are processed by Stripe; your card details are handled by Stripe and never by us. Completing checkout is also subject to Stripe's terms.

4. Cancellation & refunds

Paid access is digital content supplied immediately. Under the UK Consumer Contracts Regulations you normally have a 14-day right to cancel; by purchasing and starting to use the paid features you ask us to begin supply immediately and acknowledge that you lose this 14-day cancellation right once access has begun.

This does not affect your statutory rights under the Consumer Rights Act 2015: if the service is faulty, not as described, or not provided with reasonable care and skill, you are entitled to a remedy. Beyond that, our goodwill refund position is: as a goodwill policy, we offer a full refund within 14 days of purchase if you have used the paid features only minimally and you are not satisfied. To request a refund, email himanshu.kher@gmail.com.

5. Acceptable use

We may suspend or end access that breaches these terms.

6. Content & intellectual property

All questions, content and the application are owned by us or our licensors and provided for your family's personal practice only. No other rights are granted.

7. No guarantee of results; not affiliated

Brightspark Prep is a practice aid. We do not guarantee any particular exam outcome, score or school place. The service is not affiliated with, endorsed by, or official preparation for GL Assessment, CEM, ISEB, CSSE or any school or examination body; references to these are for compatibility/description only.

8. Availability & your data

The service is provided "as is" and "as available". We aim for high availability but don't guarantee uninterrupted service and may update, change or discontinue features. On the free tier your child's progress is stored only in your browser — you are responsible for that device and its data; clearing browser data erases it. See the Privacy Notice for how data is handled.

9. Liability

Nothing in these terms limits liability that cannot be limited by law (including your statutory consumer rights). Subject to that, our total liability to you is limited to the amount you paid for access in the 12 months before the claim, and we are not liable for indirect or consequential loss.

10. Changes & governing law

We may update these terms; the version above will change and continued use after a material change means you accept the updated terms. These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction (this does not remove protections you have under the law of your home nation within the UK).
